11th Circuit Court Allows for the Enforcement of Alabama Law Protecting Children
On Monday, August 21st, the 11th Circuit Court of Appeals removed a preliminary injunction against the enforcement of the Vulnerable Child Protection Act (VCAP).
To discuss the importance of this decision and VCAP itself, ALCAP President and CEO Greg Davis welcomed Alabama Secretary of State Wes Allen onto Priority Talk Radio. Wes Allen, who was a State Representative at the time in 2022, sponsored the bill (HB 266).
“Conservative Christian people have to pray and continue to educate our people on our side of the aisle on why this [issue] is so important. [We need] to take a stand for this because it’s such a huge issue. We have folks who can’t define what a man is and can’t define what a woman is. It’s important to keep praying and to keep speaking with boldness. I encourage our fellow believers to keep praying,” Allen said.
ALCAP was one of the organizations involved in advocating for VCAP to legislators, which bans Alabama doctors from performing transgender medical procedures and proscribing cross-sex hormones and puberty blockers to minors.
In April of 2022, Governor Kay Ivey signed VCAP into law. The law went into effect on May 8th of 2022, but a preliminary injunction was put into place by U.S. District Judge Liles Burke. The law could not be enforced for the time being until there could be a federal court ruling. Now, the preliminary injunction has been removed and VCAP is enforceable.
VCAP will go to trial in April of 2024.
